Mary is considering buying a new laptop computer and sees that her neighbour Jane is selling her laptop on a popular website. After initial enquiries, Jane tells Mary that she is looking for 500 for her 6 month-old laptop. Mary thinks the deal is too good to be true as the retail price of the laptop is well in excess of 2000. Mary tells Jane she needs to think about it, but that she is very interested in the laptop. Mary asks Jane if she can hold it for two days while she makes up her mind. Jane then says: "If I don't hear from you by tomorrow evening, I will take it that you are happy to buy the laptop at the advertised price." Both parties part ways at this point, with nothing else said between them.
Two days have passed and Jane is seeking to enforce the contract, as she did not hear from Mary in the meantime. Mary disputes that a contract was formed at all, and is refusing to buy the laptop, having subsequently learned that Jane's laptop is not in as good of condition as she first thought.
Advise Jane as to the enforceability of any contract that may have been formed.
