Compliance personnel are often tasked with learning about new areas of law / regulation and passing that knowledge on to others within their company. This weekyou'regoing to prepare videos and teach one another about a regulation that is important to your company.
Fictitious Company:
As for the fictitious company that I decided to create it's called Global Solutions, and we are going to be in the Information Technology and the Consulting Industry. Global Tech Solutions Inc. will specialize in developing cutting-edge software solutions for businesses, including enterprise resources planning (ERP) systems, customer relationship management (CRM) software, and Cybersecurity solutions. We are going to have our headquarters in San Jose, CA with two branches/subsidiaries in Berlin, Germany and in Madrid, Spain. When talking about the company's size, we will have an annual revenue of $ 2.5 billion and a total of 10,000 employees. Yes, the company is going to be publicly traded on the NASDAQ under the ticker symbol GTSI. Some of the areas of regulation that are going to affect the company are data privacy and protection, intellectual property, cybersecurity, labor laws, and financial reporting.
Assignment Instructions:
- Pick a specific regulation that is pertinent to the company you created in Module 1.
- Ex: you could choose to look at the requirement under the Affordable Care Act (ACA) that employers show employees the total cost of their health care coverage.
- You should not choose the ACA as a whole as it is toobroad for you to be able to cover in a short video presentation.
- Here are some ideas to get you started. These are mostly U.S. examples, but all of these laws have corollaries in the countries in which your company operates, so you may want to pick a foreign law to look at:
- Health & Safety Laws (Ex: fire extinguisher requirements under OSHA)
- Financial Compliance (Ex: SOX Section 302)
- Labor laws (Ex: Recent change to sick days / sick pay accruals in Arizona)
- HIPPA (Ex: Security Rule requiring risk analysis as part of the corporate security management process)
- Environmental laws (Ex: Noise Pollution Laws in the UK)
- FDA (Ex: Medical device reporting requirements)
- Data Privacy laws in India (Ex: data controllers must have a privacy policy in place)
- Ex: you could choose to look at the requirement under the Affordable Care Act (ACA) that employers show employees the total cost of their health care coverage.
2. Learn about the law you have selected. Review:
- Law itself
- Guidance from regulators
- Articles written by law firms / accountants / consultants
- Other secondary resources like textbooks / guides
3. Do a short slide deck advising your business about this law and its requirements. No more than 3-4 slides. Avoid getting bogged down in unnecessary detail.
Your slides should cover:
- Key aspects of the law
- What does the law require / say (in layman's terms)?
- Scope / applicability - does the law actually apply to your company?
- Any exemptions available?
- Any definitions your audience needs to know to be able to understand the regulation (Ex: data privacy laws are designed to protect "personally identifiable information (PII), but what actually qualifies as PII?)
- Why the law matters for your company
- Any penalties for non-compliance
- Any reporting requirements - do violations need to be disclosed to the regulating agency? is the government requiring any sort of regular reporting to prove compliance?
- Any actions that need to be taken
- Does a policy need to be adopted?
- What sorts of internal controls need to be implemented to assure compliance?
- If there is an exemption available, does your company need to apply for one?
