Crocker v. Sundance Northwest Resorts Ltd., [1988]

The resort held a promotional event that involved a competition where two- person teams slid down a mogulled portion of a steep hill in oversized inner tubes. Crocker entered the competition, signed the entry and waiver form without reading it and paid the entry fee. He was visibly drunk and suffered a cut above one of his eyes in the first heat. He suffered a neck injury in the second heat that rendered him a quadriplegic. The owner of the resort asked Crocker before the second heat about his condition but did not dissuade him from participating. The resort manager had also suggested he not continue into the second heat but did nothing to restrain Crocker when he insisted on competing.
