Homeowner lives on a hillside with a sloped back yard. Homeowner decides to cut out part of the hillside, about 100 feet around the perimeter of the property, to build a 9-foot retaining wall. The retaining wall must be engineered requiring homeowner to hire a general contractor and engineer for the construction.


One of Homeowner's neighbors is a civil engineer. Homeowner calls neighbor to review the project and to inquire if neighbor would be interested in the project. Neighbor accepts and agrees to draft the engineering plans for his ordinary fee. Neighbor also tells Homeowner that his brother is also a civil engineer and they could work together on the engineering plans. Homeowner is pleased and agrees to use neighbor and his brother for the engineering portion of the retaining wall project.


Homeowner retained ABC Construction to serve as the contractor for the construction.


After a few weeks, neighbor and his brother drew up the engineering plans and obtained all the required city permits. A few weeks later Contractor begins the project by cutting into the hillside and builds the retaining wall.


Six months after the wall was built, Homeowner notices some cracks in the wall. A few months later, the middle portion of the wall collapses. Mud and portions of the walk slide 20 feet into Homeowner's backyard causing extensive damage.
