Dispatch gets a call regarding a suspicious vehicle parked on the side of the road. The caller states that the driver looks asleep. Investigator Lockemup drives to the location and approaches the parked vehicle. He looks in the window and sees a male who appears to be asleep behind the wheel. In the passenger seat of the vehicle is a bag of fast food, some empty beer cans, and a pipe used for smoking a controlled substance. Lockemup bangs on the window until the male wakes up. Lockemup tells the man to step out of the vehicle. Lockemup searches the car. He finds a pill bottle with the label torn off in the center console. The pill bottle contains twenty tablets that appear to be controlled substances. Lockemup asks the driver about the pills. The driver says he has no idea what they are and that they are not his pills. Lockemup arrests the driver for possession of controlled substances and drug paraphernalia for the pipe. Was the collection of the evidence done properly? Why or why not?
