FACTS: On February 10, 2021, Lance was inside the SM Appliance Store. He wanted to purchase the Sony Internet TV that he saw thereat which is worth P83,000.00 but he had no cash with him at that time. He however brought his personal checkbook with him. He talked to the Sales Clerk who eventually endorsed him to the Store Manager (X). Lance requested X to let him purchase out the TV and to accept his personal check. In the course of their conversation, X was convinced that Lance is a reputable businessman and after brief inquiry by the Finance Department of SM on the background of Lance, X accepted the personal check post-dated on the next day which Lance drew and issued in the name of X that moment to cover the value of the TV. Then, Lance left and brought home the unit with him. X noticed that what was issued by Lance was a crossed-check. So the next day, he deposited the check to his account but the same bounced for being unfunded. X was so disappointed and he reported the incident to SM Management. After service of notice of dishonor to Lance had proved futile, the SM Management Inc. (as complainant) decided to file a criminal case for Violation of BP 22 against Lance (as respondent).
