Fatimah has a beautiful wedding dress that she will use for her upcoming wedding. She brings it to Nimble Laundry Pty Ltd. She has never used this particular laundry before. At the shop, she hands over her dress to the counter assistant and paid to have it dry cleaned. She was given a receipt and told that she needed to present it later to claim the dress. The counter assistant also told her that "Nimble would exert its best efforts to give excellent service but does not accept any and all responsibility to clothes left for dry cleaning". A similar clause was also printed on the ticket; Fatimah had a hard time reading it because it was in small print: "To our valued customers, while we will do our best to take care of your precious clothes during cleaning, we are not responsible for completely removing all stains during dry cleaning". Fatimah came back to collect the dress on the morning of her wedding. She was shocked to find that there was a small tear on the back of the dress below the waistline. She pointed this out to the counter assistant, who politely reminded her of the two clauses that were explained to her when she dropped off the dress. Does Fatimah have any claim against the dry cleaner?
