Harry offers $385,000 which is accepted by the seller. Harry bid $5,000 dollars more because he really wants to be near his family and share his boat which he can keep on the dock that the house has. Then Harry signs a contract with the property owner, named Bill, for the $385,000 purchase. They were to make settlement and transfer title within four weeks. Two days before the settlement date, Bill notifies Harry by phone that he is changing his mind and he is canceling the contract. Harry indicates that there is no provision for such a cancellation in the sales agreement and he really wants the property. Bill hangs up the phone on him. Harry, being upset, takes this to court for a breach of contract.
