Having successfully obtained ownership of all three Parcels, Krusty begins working on the construction of the new restaurants. However, he decides that he should first sell one of his older, unused parcels, to free up some cash (Parcel D). Krusty hasn't visited Parcel D in almost 25 years, so he decides to drive over to take a look at it, along with his survey map. Parcel D is a perfect square, 300 feet 300 feet, and is oriented exactly North, South, East, and West. Upon arrival, Krusty notices that the owner to Parcel D's East, Apu, has built a Kwik-E-Mart convenience store that overhangs about 30 feet onto Parcel D. Krusty is outraged. He visits Apu and demands that Apu tear down the Kwik-E-Mart, claiming that Apu is violating Krusty's surface rights to Parcel D. Krusty tells Apu that he didn't know anything about this Kwik-E-Mart overlapping onto Parcel D, and that he never gave Apu permission to do so. He finds out from Apu that the Kwik-E-Mart building was built 23 years ago, and so tells Apu that he is entitled to 23 years' worth of damages. Can Krusty force Apu to tear down the Kwik-E-Mart? Why or why not
