Help me expand this: 4. Was Plaintiff constructively discharged? Why or why not? Yes, Plaintiff was constructively discharged because the sexual harassment became so horrible that she could not perform her duties at work and felt she had no other option than to quit. She experienced severe sexual harassment for at least three weeks. She reported it three times and had to endure walking through the shipping department at least twice a day where she endured cat calls and unwanted attention. She had to come to work in fear of another unwanted gift or note. She could not concentrate and did not want to go to work, although she had worked there for several years and loved her duties. Quitting for the plaintiff was not a choice but a necessity due to the sexual harassment. 5. If, so, what amount of back pay, if any, is the Plaintiff entitled to? The plaintiff is entitled to the $75,000 she requested. (I would like to add $110, 000 more for the missed wages for the past 2 years.)
