here are more than several types of legal systems throughout the world, but the two that we will mostly focus on for the purposes of this class is within the United States; the legal systems utilized today throughout our country is the common and civil law systems. Dr. Robertson discusses the history in detail of both the common and civil systems in his lecture for the Introduction to the legal studies course (Dr. Robertson, 2024, Lecture # 1, 5:00). Common law originates from Britain and was used primarily by the judges to settle disputes utilizing judge-made laws and were usually not written down. Civil law is widespread in most countries throughout the world, but one exception of a civil law state within the United States is Louisiana.The following list is to provide advantages and disadvantages of both common law and civil law.The advantages to common law include stare decisis is utilized which means that cases that were set in the past will be used again when making a final judgement. This provides consistency of sorts and if there are questions to the ruling in cases, an appeal can be made to a higher court to review judgements. In some cases, the appeals can go all the way up to the supreme court which is the highest court within the nation. Over time, the common laws were written down and are referred to as statues passed through legislation. The disadvantage of common law is that it is adversarial which essentially pits one party against the other; case presentation is important to have the court side to the party most persuasive
