The making of the contract Intention to create legal relations 2. Fred, Ned and Jed are friends and neighbours. One evening Fred has a barbecue for the neighbours, and Fred, Ned and Jed have a conversation about lawns. All three agree that their lawnmowers need replacing. Jed suggests that they should buy one lawnmower jointly and use it in turns. Fred and Ned are enthusiastic and agree that that would be an excellent idea. The following day Jed buys a new \"Invicta\" ride-on mower for $1,500. He invites Fred and Ned round to see it and says \"Here it is there is no hurry but if you could let me have the $500 for your shares in the mower quite soon it would be good.\" Fred and Ned indicate that they do not understand what Jed is talking about. a. Does Jed have a legal right to demand $500 each from Fred and Ned? b. Would your answer be different if the three had discussed types of mowers and agreed the Invicta ride-on would best suit their purposes? Offer and acceptance 3. You are in a fancy shop looking for a gift for a friend. You see a rather nice glass decanter priced at $134.00. You carefully pick it up and walk towards the counter where an assistant is waiting. As you approach the counter a small child bumps into you and you drop the decanter, which smashes into a thousand glittering fragments. In the midst of your distress and embarrassment a shop assistant approaches you and says that under the store's policy You have bought the decanter and must pay for it. State, with reasons, whether you believe the shop assistant is correct in law. Anselm wished to sell a computer which he no longer required. The following advertisement was placed in the local paper: For Sale Desktop with 17\" Monitor Printer and software $750.00 Write to Box 1234 Advise with reasons whether a contract to purchase the computer exists in each of the following cases: a. Gregory writes to Ansehn at the box number and says that he will take the computer and encloses a cheque for $75. b. Anselm, separately, emails the following to Augustine, \"Are you interested in purchasing my old computer and printer, it's yours for $600.\" Augustine replies \"Sounds just right for my children's homework, is there any software?\" Thomas e-mails Anselm and says, \"I will give you $750 for the computer; if I hear nothing from you to the contrary I will be round to collect it on Saturday\". Anselm replies, \"Great, see you Saturday\". Because of a problem with the server to which Thomas is attached this reply is not received for one hour. In the meantime Thomas has changed his mind and has e-mailed Anselm, \"Sorry I have changed my mind; the car needs four new tyres and I cannot afford the computer now\". Anselm receives this after sending the reply but before the reply had been received by Thomas. Consideration 5. a. Alpha is Beta's next door neighbour. While Beta is away on holiday, a tree falls on Beta's house, destroying part of the roof. Since Alpha is a builder, he removes the tree and repairs the roof at a cost in materials of some $1,000. On his return, Beta promises to reimburse Alpha but never does so. Can Alpha enforce Beta's promise and recover the $1,000? What difference would it have made to your answer to (a) if Alpha had been asked by Beta to keep an eye on the property while Beta was away on holiday, on the understanding that Alpha would pay him if any emergency arose which required money and or effort to be spent
