Facts: An employee of a local school system told a supervisor that the School District Employee Relations Director, Mr. Boos, sexually harassed her. The Human Resources Department initiated an investigation. During the course of this investigation a Human Resources Officer, asked Ms. Lawford, a 30-year School District employee whether she witnessed "inappropriate behavior\" on the part of Boos. Note: Lawford was not the original employee who gave the employee notice of the alleged harassment. Lawford described several instances of sexually harassing behavior. Once, Boos answered her greeting, "Hey Dr. 8005, what's up?\" by grabbing his crotch and saying, "You know what's up.\" He also had repeatedly put his crotch up to her window and on one occasion, he entered her office \"grabbed her head, and pulled it into his crotch.\" Two other employees also reported being harassed by Boos. The School District took no action against Boos, but fired Lawford soon after nishing the investigation. During the course of the harassment investigation, School District learned Lawford had embezzled money from School District. The elements of a prima facie discrimination case are: 1. The employee is in a protected class (e.g. race, gender...). 2. S/he was satisfactorily performing her/his job duties 3. S/he was subject to adverse employment action, AND 4. That a non-minority replaced him/her or that similarly situated non-minority employees were treated more fairly. 1.
