Hi I'm studying Business Law 251 in Macquarie University.

I'm wondering how we could discriminate between Fiduciary duties and Statutory duties only by the cases?

The provisions of Fiduciary duties are already included in Statutory duties Section 181, 182, 183.

How we could identify whether this case is only Fiduciary duties or both Fiduciary duties and Statutory duties?

Also I leaned that Statutory duties can not be ratified because it's enforced by ASIC, then it indicates that Fiduciary duties are not ratified as well? because it is already included in Statutory duties Section 181, 182, 183 ?
