Sandra Barton worked as a team leader managing the food service and deli departments at Value Mart, a grocery retail store in Syracuse, NY. During her time at the store, Barton was disciplined on three occasions for "failing to keep the logbooks properly." On August 16, Barton failed to keep the logbook consistently for a fourth time. On catching the mistake, Dayton stated in front of other employees that "ten-year-old could do her (Barton's) job better" and that "this again proves that women cannot manage." After the incident, Barton raised concerns to Value Mart's HR about Dayton's disrespectful treatment of her and other employees (but did not raise sex discrimination concerns). On the same day, Dayton documented the circumstances and emailed the HR department, saying that "there have been numerous missing entries on the food service logs" and that "Barton is not competent enough for this position of a team leader." Two days later, Barton was fired for "violating store policy on health and safety compliance." Barton requested a reconsideration, citing the staff shortage. Value Mart rejected her request.
