After a long court battle, a Judge ordered Samantha to pay $500,000 in damages to Louisa. Since Samantha was unemployed and had no source of income, the judge ordered that a lien be placed on Samantha's house. The Judge issued the Order on March 1, 2010, but the court's lazy clerk failed to record the lien at the county clerk's office until June 1, 2010. In 2015, Samantha found a buyer who agreed to buy her house. Somehow, this buyer did not learn that Louisa had a lien on Samantha's house. The closing took place on September 1, 2015. Immediately afterwards, Samantha moved to France without having paid a single penny to Louisa. A few months later, the buyer became enraged when he learned about Louisa's lien. The buyer believed he should have paid $500,000 less for the house. With the help of a private investigator, the buyer was able to find Samantha in France and sue her for fraud. (a) Assume that Samantha took out a second mortgage on her house on April 1, 2010. Would this second mortgage have priority over Louisa's lien? (b) What happened to Louisa's lien immediately after the closing on September 1, 2015? (c) What can we infer that the buyer did not do before the closing?_ (d) What is Samantha's best defense in the lawsuit filed by the buyer for fraud? Question3: Leo signed a five-year lease for office space. The term of the lease began on January 1, 2010. When the lease expired on January 1, 2015, Leo remained on the premises and continued to pay rent, but he did not sign a new lease agreement. Leo continued to pay rent, as scheduled, throughout 2015 and 2016, but he stopped making rental payments in October of 2017. In December of 2017, Leo's landlord petitioned the court to have Leo evicted. Leo resumed making rental payments. on February 1, 2018. The landlord accepted these rental payments, but the eviction proceedings did not end. On July 15, 2018, a plumbing malfunction took place causing extensive damage to the space Leo occupied, as well as to Leo's office equipment. Leo vacated the space on August 1, 2018. (a) What type of lease did Leo have on March 1, 2011? (b) What type of lease did Leo have on March 1, 2016? (c) What type of lease did Leo have on March 1, 2018
