I need help responding to the post below (from a classmate)? Our professor ask us all to: Explain how the law and constitution were applied in the resolution and explain the issue involved. What is the law and constitution that were applied in the resolution and issues involved?

Students in public school have a constitutional right to express their beliefs by sitting out for the pledge of allegiance or the national anthem. In a few states, schools can require parental permission before excusing students from participating. Students have the option to stay silent or sit during the pledge, as a way of expressing their political or religious beliefs.Religious or Private schools require their students to stand and recite the pledge of allegiance. The are also against type of protesting.

As far back as 1943, the U.S. Supreme Court ruled that requiring all public school students to recite the pledge of allegiance was a violation of their First Amendment rights, because free speech includes the right not to speak against your beliefs (West Virginia State Board of Education v. Barnette, 319 U.S. 624 (1943)).

If school officials are threatening punishment because your child refused to participate in the pledge of allegiance or the national anthem, an education lawyer can help protect the students rights.

Do Students Have to Stand for the Pledge of Allegiance or the National Anthem at School?
