If I have registered a trademark with US Trademark and Patent Office, but another person used my trademark without my permission, and I did not

If I have registered a trademark with US Trademark and Patent Office, but another person used my trademark without my permission, and I did not discover it, would it be possible for US Trademark and Patent office to impose penalty on that person directly? Or the penalty has to be decided by the court after I have sued that person?
