In November 2020, the United States Supreme Court heard the case Texas v. USA which challenged the constitutionality of the Affordable Care Act. In that case, the SCOTUS upheld the ACA by ruling that the plaintiffs did not have standing to challenge the ACA. One of the issues in that case was that parts of the ACA could be severed from the Act and still remain constitutional.
