In the Foister case where 7 plaintiffs admitted that they misused the product (the drug, OxyContin), the court held;

a.A product is not unreasonably dangerous simply because they may be harmful or illegally used.

b.The manufacturer put clear warnings on each prescription container stating how they should be taken.

c.It is the physician that has a legal responsibility to warn a patient and the pharmaceutical/drug company only need warn the physician.

d.The plaintiffs did not present any proof that the drug was unreasonably dangerous absent its illegal alteration and use.
