IRCTC Limited invited tenders from eligible vendors to provide catering services in deluxe trains. The advertisement specified turnover of Rs 100 crores as the eligibility criteria and also declared that the tenders can be rejected without assigning any reasons. None of the respondents met the turnover criteria. IRCTC finally cancelled all the tenders and awarded the contract to one of the bidders. Aggrieved by this allotment, one of the bidders challenged the tender process. IRCTC submits that the bidder has no locus to contest the case since it (IRCTC) reserved the right to reject tenders without assigning any reason.
