Joseph Garcia was one of the "Texas 7," a group of men who escaped from a maximum-security Texas prison on December 13, 2000. Garcia was serving a life sentence for murder at the time he escaped prison. After escaping, the men robbed a sporting goods store in Irving, Texas on Christmas Eve. Irving Police Officer, Aubrey Hawkins, who had just finished dinner with his family nearby, responded to the burglar alarm at the Oshman's Sporting Goods Store (which had closed early for Christmas Eve). Hawkins was killed in a shootout with the group of escaped felons and died. SIx of the seven convicts were captured a month later (one had committed suicide before the others were captured). The remaining six were all tried for Capital Murder and sentenced to death. The investigation into the shootout indicated that Garcia, who was not involved in the shootout (in other words, he fired no shots at the officer), was convicted and sentenced to death under the Texas "law of parties."
