Just prior to his vacation, James started an ice-cream business with his friend Ben. Ben leased a store in his name and opened up a bank account for which he would have the signing authority. James took a course on ice-cream making, and created the flavours they will sell. They have decided that all the money they make will go into the bank account that Ben opened, and that James will receive a salary of $3,000 a month out of that account. Any profit that remains will go to Ben. After a few months of operation they have been extremely successful, and Ben has been drawing $10,000 a month out of the account. James feels this is unfair, since he created the flavours. He has now sued Ben for $3,500 (for each month) which James claims is "his fair share". a.
