To improve his self-defense skills, Kyle signed up for 10 karate class sessions at the Alpha Dog Martial Arts Center, for which he paid the total cost of $1500. During the initial 10 class sessions, Kyle was told that he was "an excellent karate student," "mastering the art of self-defense," and "with a few more classes would become a national champion in karate.\" Based upon these statements, Kyle signed up in writing, and paid for 20 more karate class-sessions at a fee of $3000. The additional class package had a written \"no refund policy\". The day after signing up for additional karate classes, Kyle got into a fight with an averaged sized 6'\" grader with no martial arts training. Kyle suffered a bloody lip that required ten stitches, and received $1000 in medical bills. After this ght, Kyle realized that he was not very good at self-defense and that he could not possibly be "mastering the art of self-defense," so he decided not to attend the karate course for which he registered under the "no refund\" policy. Thereafter, Kyle demanded the return of his $3000 and Alpha Dog Martial Arts Center refused. Kyle then sued the Alpha Dog Martial Arts Center for return of his $3000.
