Liam works for an off shore oil rig in Bass Strait. He has recently been absent
from work as he has been taking a lot of his sick leave. He often does not make
his rostered shifts which are at night. He likes these shifts because they pay
more. His manager called him in one day and asked him whether he would
agree to a change of rostered shifts during the day. This was because they
needed more reliable staff at night and he was not turning up due to his sick
leave. Liam refused. The manager insisted as he said he needed to ensure the
operational requirements of the oil rig were satisfied. The manager then said if
he did not agree to the change in roster it could lead to his dismissal.
Liam did not agree to the change and he was summarily dismissed for serious
misconduct.
