Lola Lee saw an ad in the Times Colonist for the sale of a house in a residential area of Victoria. She approached the owner, Mark Madill, and they went out to a restaurant to talk it over. Late in the evening, when both of them had shared more than one bottle of wine and a good meal, during which they negotiated, Mark orally agreed to sell the house to Lola for $700,000. Lola gave Mark $10,000 cash on the spot as partial payment, the rest to be given upon transfer of the house. Two days later, Mark changed his mind and sent Lola a letter referring to the deal and the headache he had after their dinner, and stating that he would not honour the agreement. Question: Discuss the likely outcome of this case. In your discussion include the elements/defences available to the plaintiff and what facts support those. Also include what remedies the plaintiff would be seeking and finally set out one method of risk reduction for either party
