Q1) Hamzah who loves mountain biking is a student studying Accountancy at NUN. On

01/03/2021, Hamzah saw an advertisement made by Adam in a flyer offering to sell

his mountain bike at a price of RM9,000. On 02/03/2021 he wrote a letter to Adam

accepting the offer. Unfortunately, the letter was only received and read by Adam

on 05/03/2021.

Sarah saw the same advertisement made by Adam in a magazine on 03/03/2021.

She immediately faxed a letter to Adam proposing to purchase the bike at a cost of

RM8,000.00. Adam only read the fax on 04/03/2021 and replied that he would

accept Sarah's proposal if the price is RM8,500. Sarah agreed.

Prior to this, Sarah had made a proposal to purchase a similar bike at RM9,000 from

Shirah on 01/03/2021. Since the price offered by Adam is cheaper than Shirah, she

sent a letter revoking her proposal on 03/03/2021 which Shirah received and read

on 06/03/2021. Hamzah was on his way to Sarah's house when suddenly Daniel run

across in front of his car. Hamzah swerved his car to the right and knocked into

John's car. John is suing Hamzah for RM50,000 for the injury he had suffered as a

result of that accident.

Advise Hamzah, Sarah and Shirah and discuss on the validity of the agreements that

they have entered into and John on his suit against Hamzah and explain which court

will have the jurisdiction to hear the case.
