5 . Evelyn purchased a used motocross motorcycle from Biker World, a dealer in motorcycles. When Evelyn asked the salesperson about the mileage, the salesperson stated the motorcycle had been driven only 1,000 miles, had never been raced, and needed no major engine repairs. Evelyn purchased the motorcycle based in part on the salesperson's representations. Later the motorcycle quit running. Evelyn took it to Frank's Cycle Repair, who said the motorcycle needed $1,200 for major repairs to the engine. Frank informed Evelyn that he had previously worked on the motorcycle for the former owner who had actually driven it over 10,000 miles, had entered it in several racing contests, and that the bike had needed major repairs in the past. Does Evelyn have a tort claim against Biker World and/or the salesperson?
