Nestle was then sued by the owner/composer of the record for violating the Owner's copyright and selling the Owner's Intellectual Property without a license (permission). In its defense, Nestlé argued that they were not "selling" the record because the wrappers were worthless and were thrown in the trash, thus there was no Consideration.
