On December 15, 1956, Marvin Briscoe and another man hijacked a truck in Danville, KY. They were caught and convicted and Briscoe served a 1-year term in prison. After release from prison, Briscoe established a life of respectability. In 1967, Reader’s Digest published an article entitled “The Big Business of Hijacking.” The article contained a description of the incident involving Briscoe and named him as a participant in the hijacking. As a result of the publication, plaintiff’s 11-year-old daughter, was well as his friends, learned of his criminal record for the first time and scorned and abandoned him.
