Because of a long line, Graham exited the storequickly, and requested his friend who had given him a ride take him to another store. An officer,Connor (respondent), was present and viewed Graham leaving the building and was suspiciousthat an unlawful activity may have taken place. With this suspicion, Connor followed the vehicleand made an investigatory stop to question Graham about why he left so quickly. Grahamsustained injuries from the events that took place following the investigatory stop, including abroken foot. Graham was eventually allowed to be freed upon Connor discovering no criminalactivity took place while Graham was in the store. Graham filed charges against Connor as wellas other officers who were involved in the stop, alleging violations of his rights by use ofexcessive force, unlawful assault, unlawful restraint constituting false imprisonment, and thatofficers were improperly trained in the Rehabilitation Act of 1973
