One of the main areas of my law practice is representing people who allege they have been injured at work and should receive workers' compensation benefits. In North Carolina, an employee can receive workers' compensation benefits regardless of who was at fault for causing the employee to get hurt as long as the employee was injured in the course and scope of his employment. For example, even if a person shouldn't have gotten on a ladder high off the ground without making sure it was secure, if the person falls off the ladder, he has a legitimate workers' compensation claim if he was working when the accident occurred. However, that person is only entitled to two-thirds of their average weekly wage at the time of the injury, and they cannot, under the law, receive any money for pain and suffering or for changes in their lifestyle, such as never being able to play with their children again.
