With no standard form for a brief of a court opinion or any hard-and-fast rules governing the format, you may notice some sections in the assignment you have not used before. Build on your experience in other classes and Chapter 4 of the textbook case brief of this well-known Supreme Court Decision. Instructions: 1. Read Chapter 4 - specifically the section on briefing a case. 2. Review the elements of a case brief found in Chapter Four. 3. Using Westlaw or Nexis Uni locate Gideon v. Wainright. 4. Case Brief with the following mandatory sections: a. Citation - The citation includes the name of the parties, where the case can be found, the court that issued the opinion, and the year of the opinion. (minimum length - one sentence) b. Parties - The caption at the beginning of the opinion gives the full name and legal status of each party. (minimum length - one sentence) c. Facts - The facts section of a case brief includes a summary of the facts that describe the history of the events giving rise to the litigation. The facts section should include key facts and just enough background facts to provide the reader with context. (minimum length - one paragraph) d. Procedural History - The chronology of events that occurred in each court before the case reached the court whose opinion you are briefing. (minimum length - one paragraph) e. Issue - The legal question addressed and answered by the court. It is the precise legal question raised by the specific facts of the case. It is the decision of the court, the answer to the issue. There should be a separate holding for each issue identified in the issue section of the case brief. (minimum length - one paragraph) g. Reasoning/Rationale - Usually the largest part of the opinion is the court's presentation of the reasons in support of the holding. Just as for each issue there is a holding, for each holding there should be reasons explaining why the holding was reached. (minimum length - one paragraph) h. Comments - Include in this section of the case brief any observations you may have concerning the court opinion. (minimum length - one or two sentences) Requirements: Please submit this assignment as a Word Document. One - two pages. Include at least one citation either from your textbook or an alternative reliable source. Cite your sources according to the legal citation and APA guidelines. Be sure to read the criteria by which your work will be evaluated before you write and again after you write.
