Partner Tom Collins has recently moved back to Maryland after many years practicing abroad. He has asked you to refresh her memory regarding the specific procedures associated with litigating a tort cause of action in the state of Maryland. He would also like you to demonstrate my understanding of this process, as he hopes that you will become part of his litigation team.

What is the process of litigating a tort cause of action in Maryland? This process is sometimes referred to as the "structure of a tort case."  Such examination includes the following information:

 1.  The Parties to the action and their respective roles and functions.

 2.  Describe what is meant by the "legal basis" for a tort cause of action, or claim.  Note whether more than one cause of action may be alleged in the initial filing, or Complaint.

 3.  What are other specific information that must be included in the initial filing known as the Complaint.

 4.   Identify the Burden of Proof Standard.  Also include a comparison of such standard to the standard used in a criminal proceeding.

 5.  What other procedures (e.g., responses or affirmative defenses) possible in the tort litigation process.

 6.  What are  at least three specific statutory deadline that should be identified at the outset of the case.
