Peter is an amateur photographer. For many years, he has enjoyed shooting portraits and street photography, particularly on Spadina Avenue. Recently, his main camera broke down, so now he is looking to buy a new camera in anticipation for a trip to Hanoi, Vietnam, in about a about eight months time. Peter decides to visit his friend, Griffin, a second-hand seller of cameras, and tells him exactly what kind of photos he plans on taking, and the specifications of the camera he is looking for. Griffin, of course, suggests an expensive camera that is supposed to have all the bells and whistles that Peter is looking for. Peter asks Griffin about the cameras durability, especially with respect to dust, dirt and water that may get into its systems. The salesman informs Peter that this model is the most durable on the market, offering a warranty on various forms of damage, including damage caused from light exposure to water, as long as the camera is used normally and not in extreme circumstances. Griffin goes on to say that the camera can even operate underwater. Peter instantly thinks about all the photos he will be able take underwater with this camera. Being somewhat gullible, he never bothers to fact check Griffins claim but if he did, he would have learned that it was false. Peter pays Griffin for the cost of the camera (which is still covered under the manufacturers warranty) and in the process of doing so, Griffin tells Peter to take a little while to play around with the camera and see if its too his liking; if hes not satisfied, hell give Peter his money back if he decides to return the camera.
Eight months later, Peter is walking the streets of Hanoi, trying to take portraits of street vendors and children. So far, he is struggling with his camera. The various focus functions are not working properly and none of his portraits are coming out correctly. Peter is starting to wonder if the camera he bought really was appropriate for the types of shots he wants to take, which he tried to explain to Griffin. Right when he stops to take a picture of a shopkeeper outside his store and lost in thought, a flash downpour of rain hits the area. Most people try to find cover but Peter stays in the rain to take photos, remembering the water proof capabilities of his camera that Griffin told him about. After a minute though, his camera stops functioning. Hes distraught as the only device he now has to take photos is his 10-year-old cell phone.
As soon as he goes back home, Peter plans to seek your help so he can know if he has any claims of any kind. He also remembers that he never got back to Griffin on his satisfaction of the camera. What are all the issues in play here? How would you advise Peter of his possible options?
