Plaintiff, Smith was injured when his truck was run into by a truck of the OhioOil Company. Plaintiff recovered $50,000 and defendant appealed. A medical witness for theplaintiff demonstrated a model of a human skeleton to assist in explanation. This was said toarouse emotion or portray dramatic effect rather than explain anything to the jury. X-rays werepermitted as evidence to illustrate the injuries to which he used the plastic skeleton model to aidin showing the displacement of bones. The court concluded that the explanation was relevant andhelpful therefore the ruling was correct.
