Our client, Mr. Rigatoni held a Halloween party for his customers, and those who arrived in costume received a discount on their cover charge.Mr. Rigatoni had erected a floor-to-ceiling maze of cornstalks.The customers had to work their way through the maze to find the bar, the food, and the music. He has held this party in the same way for several years, and it is always very popular.Last year, he had to make people wait for someone to leave before he could allow customers to enter because the Code limited the occupancy of the room to 300.
Despite the ban on smoking in public places, some people were smoking marijuana during the evening. At some point, one of those people accidentally caught the corn maze on fire.Although no one was killed in the fire, one woman, wearing a very flammable costume that caught on fire, was seriously burned and suffered lung damage from smoke inhalation.
This woman is suing Mr. Rigatoni because she was unable to find the exit during the fire. She claims that the cornstalks obstructed her view of the signs. Mr. Rigatoni maintains that it wouldn't have mattered whether there were cornstalks or not because he had turned off the illuminated exit signs. He said that the lit signs spoiled the atmosphere of the party.
