I currently have identified the issues of: ambiguous term, Parol Evidence Rule, Signature rule (Toll v Alphapharm), Inclusion of price rule (Mushroom Composters) and potentially unilateral mistake and damages but am not if they are correct. In May, Piggy, a meat market owner, called Alpha and asked whether Alpha could install six used coolers that Piggy had recently purchased. The coolers were to be installed in a new meat market that Piggy was opening. Piggy emphasized the need to complete the installation by January 22, in time for the new market's grand opening on that day for the Australia Day holiday on January 26. On January 2, Alpha met with Piggy, and after a brief discussion Piggy signed a form entitled \"Authorization Agreement." The document provided that: \"In consideration of $12,000 to be paid on completion of the work, Alpha will install in Piggy's meat market six used coolers, including pressurizing all cooling lines and calibrating the equipment for proper temperature within 20 days from the making of this contract." Alpha told Piggy that he would sign the Agreement and send it back to Piggy as soon as Alpha had verified that he had the necessary compatible fittings for the valves on the used coolers. On January 5, having verified that the compatible equipment was on hand, Alpha dated, signed, and sent back to Piggy the Authorization Agreement. Alpha's crew began installing the equipment on Monday, January 17, and by Friday, January 21, had installed five of the six coolers with pressurization and calibration complete. The crew chief informed Piggy that he and his crew would be back on Monday, January 24, to finish up the installation. Piggy became enraged and told the crew chief that she specifically told Alpha that installation would have to be completed by January 22 and that Alpha would be in breach of contract if the chief and his crew waited until Monday to finish up the job. The crew chief phoned Alpha and informed him of the situation. Alpha, in turn, phoned you, his lawyer, informed you of all of the above facts, and asked whether he is contractually obligated to complete the installation by January 22 (which means that he will have to pay his crew overtime pay for working on a Saturday), or can they complete the installation on Monday l[January 24}. Advise the parties on contract law issues only arising from the above. (20 marks) 5 marks will be allocated for structure, evidence of research, expression, spelling/grammar and correct referencing for a mark out of a total of 25 marks
