AM Mon 19 Apr Question 1 Jane runs a business providing eyelash extension and brow services known as \"Lashes and Brows'i One of her regular customers, Susie has an existing contract with Jane to provide six sessions of eyelash extensions. Susie made an appointment with Jane to do her eyelash extensions under the said contract and decided to arrange a similar appointment at the same time, with Jane for her best friend, Betty. Betty's birthday was approaching and Susie decided to pay for Betty's eyelash extensions as a gift to Betty, There were many customers at the salon when Susie and Betty arrived for their appointment. Aer settling them on the beds in the same cubicle, Jane realised that she did not have sufficient solution needed for attaching the eyelash extensions. She stepped out to the storage area to get the same, While collecting the solution, Jane had to simultaneously attend to a new impatient customer who had some questions which Jane's colleagie could not answer, In the rush, Jane picked up the wrong solution without checking the labels Instead of picking up the solution to be used for attaching the eyelash extensions, she grabbed a bottle of disinfecting solution. Both solutions looked similar, were colourless and were stored in similar bottles, differentiated only by the labels on the bottles which Jane did not check, After she applied the solution on both Susie's and Betty's eyes, their eyes became swollen, red and itchy and they started tearing very badly Both Susie and Betty could not see properly and had to be rushed to the hospital for emergency treatment. Each of them had to be hospitalised. Answer the following questions SEPARATELY AND INDEPENDENTLY, Required (a) Advise Betty if she can claim against Jane for the injuries she sustained and her losses in connection therewith, (25 marks) Assume that the business \"Lashes and Brows\" is a general partnership with Jane and her sister, Joan as partners Assume mher that Jane was held to be liable to Betty for the injuries she sustained and her losses in connection therewith. Advise if Joan will be liable to Betty as well and if so, the legal basis for the same.
