SCI sells all types of Halloween candy , but its topselling item is the "Ghost Pop ," which is a lollipop where the candy on the stick is shaped like a ghost. SCI is incorporated under the laws of Delaware , and operates out of its headquarters in Michigan. Copycat Candy, LLC (\"Copycat") is a limited liability company that also makes candy. While it manufactures and sells all types of candy, it has recently expanded its operations to include specialty Halloween candy. Copycat is organized under the laws of Wisconsin. Its primary factory and corporate headquarters are in northern Wisconsin. SCI has only two owners, and they both live in lvlichigan just across the border om the corporate headquarters in Wisconsin- Earlier this month , an SCI employee was at a candy store in Pittsburgh , Pennsylvania and saw an item that looked exactly like SCI's \"Ghost Pop." The lollipop had virtually the exact same coloring and design. SC] saw that the candy had been made by Copycat. The SCI employee later got online and saw that Copycat's website contained images of the candy resembling the "Ghost Pop " on its website , but it did not sell anything directly on the site. Instead, it listed phone numbers for those interested in purchasing candy. Copycat does not make any direct sales in Pennsylvania. Instead, Copycat sells its candy to a wholesaler (a di'erent company ) in Wisconsin , and the wholesaler then sells the candy to various retail stores in the region . One of these stores is in Pittsburgh , Pennsylvania . Copycat does receive a regular reporting from the wholesale company about where its candy is selling, including Pennsylvania. Copycat however does not have any 1 'J communications or relationship with these retail stores where the candy is sold . SCI led a lawsuit in federal district court in Pittsburgh , Pennsylvania asserting an unfair competition claim under Wisconsin law and federal copyright infringement claims.
