Case#2: Yes John is eligible & proceed for filling the patent for his invention before this invention is intimated (copied) by some other person.
Case#3: Yes, Ted is most likely to succeed because as per the legal process "probate" is the court-supervised process of gathering a deceased (dead) person's assets & distributing them to inheritors. Because the will has clearly avoided the provision of transferring the fortune to the next generation of Jones. If Jones was not ready to transfer any fortune to his son then he should have clearly mentioned it in the will.
