Question 2 (30 marks) Peter, a wholesale fish merchant, wished to expand his lobster trade by buying lobsters cheaply in the summer, storing them in a tank and reselling them at Christmas when the prices are high. The scheme required sea water to be pumped continuously through the tank to oxygenate the water and thereby keep the lobsters alive. The tank and pumps were installed by John. The pumps were manufactured by Patrick Within a few days of installation, the pumps started to stop working and on one occasion, Peter lost his entire stock of lobsters. The cause of the problem was due to defective pumps. Peter obtained judgment against John but, since it had gone into liquidation, the judgment was not satisfied. Peter, therefore, brought an action in negligence against Patrick claiming compensation for the following losses:- A. the cost of the pumps; B. the cost of electrical engineers called out to deal with the pumps; C. the loss of lobsters; D. the loss of profit on intended sales of the lobsters. Advise Peter on his legal rights of the above items of claim.
