You received a flier in the mail to attend a science convention at the Osborne Hotel. You have always loved science, and one of your idols, Dr. Otto Octavius who was throwing the gala, was supposed to give the key note address; so, you were keen on going. When you arrive, it's exactly as you imagined with all of your favorite science "guys" in attendancea real who's who of nerds. Any ways, at the end of the convention there was supposed to be a massive reveal of an incredible finding from Dr. Octavius himself. However, as the time for the reveal comes closer you begin to suspect something might be off, as individuals begin to rush behind the scenes and a general feel of panic sweeps across the convention. You don't know much, but the experiment had something to do with new findings for conventional uses for gamma radiation and particle acceleration (that sounds plausible). However, unbeknownst to you and the other convention goers, the experiment has failed in drastic fashion, as the lead pigs designed to hold normal radioactive materials had somehow failed to contain the massive amount of energy put off by the new radioactive isotypes. This was based on the isotopes' highly radioactive nature and their new ability to vibrate at such high rates of speed (based on the particle acceleration experiments) essentially giving them the ability to easily phase through their lead containers. This means that everyone in attendance has been increasingly exposed to massive amounts of radioactivity. Suddenly, several people near you begin to mutate into hideous and wildly dangerous creatures. Somehow, you're immune, at least you think you are, as you have yet to turn into some Cronenberg creation and sprout an extra hand or arm from your face. However, that doesn't mean you're safe. In fact, several creatures who had previously been this lovely couple that you had shared a cocktail with and a fairly rude waiter, began clawing at you with extreme ferocity. Miraculously, you are able to avoid their blows, until you realize you are somehow, like the isotopes themselves, able to phase through matter, meaning nothing can touch you. This seems cool at first, but the excitement quickly dissipates, as you continue to take in the horror that surrounds you. The scene from the event continues to unfold with men, women, children, and once beloved scientists turning into horrifying monstrosities in front of your eyes, the sight of which causes you massive trauma. Oh, the humanity! To make matters worse, your new-found ability also comes with a negative side effectyou cannot turn it off. So, no one will ever be able to hold or even touch you again, essentially cutting you off from all human contact. You also become immortal and no longer need to eat or drink, but this too comes with the consequence of having to watch as all the individuals you ever loved in your life grow old and die, forcing you to live an existence alone and unloved. Dr. Octavius manages to survive the ordeal. So, you decide to sue Dr. Octavius and the Osborne Hotel for causing you severe emotional distress, loss of consortium for any and all human contact, and whatever else you can come up with. Based on the lecture and cases you've read, do you have a case? What duty of care did the hotel and Dr. Octavius owe to you? Also, what theory could you sue for: negligence, strict liability, or both?
