What if Criminal Law did not Evolve

In a world where criminal law did not evolve, societal growth and the justice system would be significantly hindered. It's critical to our society for criminal law to adapt to our changing social norms, technical advancements and new threats we receive, to maintain order, protect our rights, and maintain justice. Without constant evolution, criminal law would become outdated and undoubtedly result in unjust and unfair situations.

Issues

To start off, outdated criminal law wouldn't be able to address new types of crimes and deviant behavior. (Gaxiola, 2024) A good example of this is the rise of crime using technology, stuff like online harassment and identity theft exist now. If our laws didn't continue to evolve with us, we wouldn't be able to incorporate these as new crimes into the legal system which means we wouldn't have the legal framework to prosecute cases involving deviant behaviors online. This would allow criminals to exploit our outdated law system.

Secondly, social norms have changed significantly throughout the years. For instance that prohibited stuff like same sex relationships or interracial marriage have long since been repealed to abide by what we now know as human rights and equality. Without the ability to evolve we would be living with outdated laws still in place, creating inequality and prejudice in our modern society.

Outcome

Overall, a criminal law system that does not evolve would result in a society incapable of addressing injustice and protecting our individual rights. It would maintain outdated laws and limit our capacity to outlaw new crimes, and make it virtually impossible to correct historical wrongs like we are able to know with our evolving society and knowledge of the mistakes we've made while shaping our criminal law system. The evolution of criminal law is, and always will be vital to ensure our society continues to grow and endorse correct legal frameworks.
