Responding to employment questions is a basic requirement during every employer's hiring process, whether in person, virtual, or in writing. Many employers ask inappropriate employment questions, and some still ask illegal questions. Questions about age, citizenship, criminal record, disability, family, gender, marital status, military, national origin, parental status, race or skin color, religion or creed, and residence can be considered illegal depending on how they are worded and what information they are seeking. The questions below are some examples of illegal employment questions. I believe these questions are illegal because they violate anti-discriminatory laws that are in place to protect all people from unfair treatment based on certain personal characteristics. They can also be used to discriminate against certain applicants. In California, the Fair Employment and Housing Act (FEHA) prohibits employers from asking applicants certain questions during the hiring process. The Civil Rights Department enforces state laws that make it illegal for an employer to discriminate against an employee or applicant. How old are you? Are you a citizen of the U.S.? Have you ever been arrested? Do you have any disabilities? Where are you originally from
