Based on what was presented I disagree with the hearing officers decision and think the parents were correct to seek an appeal. I believe when the appellate court happens, they should find that the student was denied a FAPE and are owed compensatory education or reimbursement for private school. It was wrong for the school to deny the results of the evaluation made by a third party. It is the parents right to seek an evaluation conducted outside of the school district. The school is also obligated to take that evaluation seriously. Because the parents continued to enroll they're child in private school after their evaluation was denied, they are owed the cost of that education. This is because it was the school denying a FAPE for the child that the parents were effectively forced to seek an appropriate education elsewhere
