Ruger owns a business that caters to dog owners who adore their dogs. Ruger's business, "It is a DOG life" sells dog bones made with the highest quality ingredients. One day, the business runs out of gourmet peanut butter for it's Butter Bones. Ruger sends Charlie, an hourly employee of the business, on an errand to pick up some gourmet peanut butter about 20 miles away. Charlie is still clocked in as an employee.. Ruger gives Charlie precise directions.
He tells her to take her own car and the company will reimburse her for the gas. Charlie takes off on the errand, but, five miles into the errand, finds that her gas tank is on empty. As a result, she pulls into the closest gas station she can find which is about 3 miles off the directions given by Ruger. Charlie fills up her car with gas and starts to drive off without removing the gas nozzle from her car. As she pulls out, the nozzle that is still in her gas tank causes severe damage to her car's gas tank, as well as damage to the pump at the gas station. Charlie is flustered and upset. She jumps out of the car, pulls out the nozzle, and throws it at the gas station attendant, hitting him in the head. Charlie then proceeds to' follow Ruger's remaining directions to get to the peanut butter place, get the gourmet peanut butter, and then return to the "It is a DOG life" store. Charlie tells Ruger nothing about the gas station fiasco.
Ruger finds out when the gas station owner calls him and says, "I hear you sent Charlie on an errand for your business.
Issue: Is Ruger's "It is a DOG life" business liable for 1) injury to the gas station pump from Charlie driving out while the nozzle was still in the tank and/or
2) for Charlie throwing the nozzle at the gas attendant, hitting him in the head?
