Sasha and Leon were having marital problems and had an argument over whether or not Leon should buy a motorbike. Sasha went to her sister Nancy's house where they talked and got very drunk. Sasha decided it was all her fault, so she went to a local motorbike store and selected the bike she knew Leon wanted and paid for it with her credit card. The salesman was unaware that she was drunk. The next day Sasha was had no memory of the transaction and was horrified at what she had done. Sasha discovered the sales slip and motorbike outside and called the company to let them know she was returning it immediately. Even though Sasha repudiated the contract promptly name sober she can be held to the contract since the salesperson had no idea she was so drunk that she did not know what she was doing. Since she made the contract to save her marriage, it is a necessary and drunk or not she is bound to it. Since Sasha repudiated the contract immediately once she became sober, she cannot be held to it. Sasha cannot use her own voluntary behavior in getting drunk to excuse her from the responsibility for the contract. Since she was so drunk that she did not know what she was doing she lacked the capacity to make a contract and cannot be held to it
