Scenarios: M.L. was not able to bring all of her immediate family to the United Statesshe had to leave behind her eldest daughter (who is a minor) and her husband in Dystopia. There is a civil war raging in Dystopia and M.L.'s husband has made public his opinion that the Dystopian Government is corrupt and the rebel forces should be in power. In fact, he was recently convicted of a political crime in absentia (in his absence) in a civil court in Dystopia. Like M.L., he holds anti-Government opinions and is likely being persecuted for his views. The husband and daughter have managed to make it to the border of Dystopia and the U.S. and are pursuing legal and illegal means of entering the U.S.

Question : 1. Another colleague in your office is researching the application of the UDHR and the ICCPR to her husband's persecution in Dystopia for his views. Briefly describe what other treaty, convention or instrument might be applicable to the Dystopia government's persecution of the husband for his views? Why?

2. If M.L.'s husband and daughter enter illegally, can they be penalized according to international law? Is her husband precluded from applying for asylum and receiving refugee status on account of his conviction, according to international law? Briefly explain your answers.

Scenario: Jolanda is 10 years old and lives in a village in Africa. She loves school, but it starts just after dawn. She needs to go to the village well at the beginning of every day to get water for her family, which causes her to arrive late at school.

Question: 5. The village council has invited your NGO to visit for a week to discuss how they could improve human rights in the village. They are willing to review individual complaints. Your NGO director has assigned you Jolanda's case. You have 8 minutes to review Jolanda's case with the village council. What human rights issues and treaty provisions will you discuss? Provide a brief analysis and conclusion for each issue.

6. The village council has asked you to look at Jolanda's case more carefully. You have found out that when Jolanda arrives at school she sits at the back of the class with all of the other girls, where she has trouble hearing the teacher. The girls next to her seem to have no trouble hearing the teacher and following the class, so she tries to keep up by looking at their notes, but she is falling behind. Write a brief note to the village council on your findings of possible additional human rights issues and applicable treaties or norms and very briefly discuss what resulting recommendations you might make.
