Seamus owned the Briny Shores seaside resort in fee simple. Although Seamus had no children of his own, he had two younger siblings: brother Finnigan and sister Nessa. Seamus wanted to ensure that they enjoyed the benefit of Briny Shores. Upon Seamus's death, Finnigan and Nessa inherited a fee simple in Briny Shores as joint tenants, and for years, they ran the business together. While there was no conflict between the siblings in the operation of the resort, trouble arose after Finnigan suffered a tragic fishing accident. Nessa learned that Finnigan was planning to pass his interest in Briny Shores by his will to his son Quinn. Quinn, who had no interest in running a seaside resort, was threatening to sell his interest and get out of the business. Nessa sued the estate of Finnigan.
